Public offer
1. General Provisions
This document is a public offer (hereinafter — "Offer") from the individual entrepreneur Tkach Yurii Serhiyovych, registered in accordance with the legislation of Ukraine (hereinafter — "Executor"). It defines the terms for providing digital services through the website https://to-tell.com (hereinafter — "Site", "Service"). Acceptance of this Offer (including starting to use the Site, paying for services, or placing an order) constitutes a contract between the Executor and the Client.
2. Subject of the Agreement
2.1. The Executor provides the Client with digital information services: the ability to create and store publications, providing a link and a QR code for these publications, the option to extend the storage period, and other related services listed on the Site.
2.2. The Client may also be offered to order a physical plaque with a QR code through a third-party supplier. In this case, the Executor acts solely as an intermediary in transmitting the order.
3. Service Cost and Payment Procedure
3.1. The current cost of services is indicated on the Site and may change. Payment is made through an online acquiring system.
3.2. Services are considered rendered upon successful payment and the automatic extension of the publication's storage period.
4. Delivery of Physical Goods
4.1. If the Client orders a physical plaque, its production and delivery are carried out by third parties.
4.2. The Executor is not the manufacturer of the plaques and is not responsible for their quality, delivery times, or other actions/inactions of the manufacturer or delivery service. The Client must address all claims regarding physical goods directly to the relevant manufacturer or supplier. Contact details are provided during the ordering process.
5. Rights and Obligations of the Parties
The Executor undertakes to:
- Extend the publication's storage period for a specified term after payment.
- Store publications for the paid period or until the Site's operation is terminated (whichever comes first).
- Inform the Client about the end of the storage period, if possible.
The Client undertakes to:
- Not post information that violates the laws of Ukraine, the rights of third parties, or generally accepted moral standards.
- Not use the Service to distribute prohibited or harmful content.
6. Liability
6.1. The Service is provided "as is." The Executor does not guarantee uninterrupted or error-free operation of the Site, or that the service will meet the Client's expectations. The Executor, its developers, or owners are not liable for any direct or indirect damages (moral, material, financial) related to the use or inability to use the Site.
6.2. The Client is solely responsible for the content of their publications. The Executor does not moderate publications for compliance with laws or moral standards and is not responsible for third-party content. In the event of content that violates current legislation, third-party rights, or moral standards, the Executor has the right to remove it without notice.
7. Refunds
7.1. The Client has the right to a refund for digital services within 14 days in the case of a technical error where the publication's storage period was not extended. Refund requests are reviewed individually within 7 business days.
7.2. If a publication is removed due to a violation of the terms of this Offer, no refunds will be issued. Refunds for physical plaques are handled in accordance with the policy of the third-party supplier.
8. Personal Data Protection
The Client consents to the processing of their personal data in accordance with the Privacy Policy posted on the Site.
9. Changes to the Offer
The Executor has the right to change the terms of this Offer at any time without prior notice. The new terms take effect from the moment they are published on the Site. By continuing to use the Site after the changes have been made, the Client automatically agrees to the new terms.
10. Jurisdiction and Dispute Resolution
This Agreement is concluded in accordance with the current legislation of Ukraine. All disputes are resolved through negotiations. If an agreement is not reached, disputes are to be resolved in a court of law in accordance with the legislation of Ukraine.
